See Other Information for Locations. -Responsibilities WHAT DOES AN ATTORNEY (ESTATE TAX) DO?IRS Attorneys in the SB/SE Division specialize in Estate and Gift Tax law, conducting examinations to determine tax liability of the full range of estate and gift tax returns, as well as generation-skipping tax and fiduciary income tax returns. Attorneys may also specialize as tax advisors who analyze legal tax issues to develop new tax administration initiatives, or to provide analytical legal research. WHAT IS THE SMALL BUSINESS/SELF-EMPLOYED (SB/SE) DIVISION?The Small Business/Self-Employed (SB/SE) Division provides examinations and taxpayer education services for about 7 million small businesses and upwards of 33 million self-employed and supplemental income taxpayers. As an Attorney, you will: -Specialize in Estate and Gift Tax law and conduct examinations to determine tax liability. In determining the correct tax liability you will ensure that the valuation of the assets included within the estate and gift tax returns have been appraised correctly and accurately. -Examine a decedent's financial, medical, or personal records to determine full inclusion of all assets held by them prior to death. You receive and review the Tax Forms 706, 709 and 1041 and review and analyze these forms for valuation, asset, and income accuracy. -Inspect and examine wills/trust instruments provided by the estate to see if the returns were prepared accurately in accordance with the directives of the wills/trust. -Analyze the financial information on tax returns, read and analyze the wills and trust instrument associated with an estate, analyze appraisals of entities and assets and determine the accuracy of the appraisal or refer the review to an IRS expert or outside expert appraiser to seek a determination or critique. -May serve as an Attorney Adviser rendering advice and assistance in handling critical, sensitive, or confidential matters including tax related legal issues. -Examine estate, gift, and generation skipping and fiduciary returns. -May lead a team of individuals in the examination of estate, gift, generation skipping and fiduciary returns. -THIS POSITION IS AN EXCEPTED SERVICE POSITION. Specialized experience for this position includes: experience that demonstrates thorough knowledge of Federal estate and gift tax laws, judicial decisions and precedents including but not limited to fields of law such as wills and trusts, probate, contracts, real and personal property, corporations, commercial law and insurance. Your experience must also demonstrate skill in researching and evaluating complex legal questions to determine tax liability pertaining to Federal estate and gift tax returns; and skill in interpreting and explaining complex points of law and valuation matters to legal and factual situations and to persuade highly competent representatives concerning determinations made on tax issues and liability. Must have experience working with financial, professional or business accounting practices to analyze fiduciary, estate or gift assets (such as intangible factors, large corporation). Experience writing clearly and concisely reports and work papers to include significant issues, findings and analyses of legal and factual situations encountered. - The experience may have been gained in the public sector, private sector or -.
