Position Description:
We are seeking a highly skilled and experienced Healthcare Operations Counsel to provide legal guidance and strategic counsel for our healthcare operations. The ideal candidate will be a trusted advisor to senior management, supporting the organization in navigating the complex regulatory landscape of the healthcare industry, and healthcare operations on complex legal and operational issues. This role will be responsible for managing legal risk, ensuring compliance with federal and state healthcare laws, and providing proactive legal support to operational teams across the organization. Position Summary:
• Experience in day-to-day healthcare operations issues, physician and hospital contracts.
• Provide legal counsel to senior leadership on healthcare operations, including issues related to compliance, risk management, general corporate transactions, employment, medical staff issues, patient concerns, and regulatory matters.
• Participates in the development of system policies and procedures and assists senior legal counsel in legal research.
• Assist in development of policies, procedures, and methods for achieving company goals within appropriate legal parameters, such as generation competitive bid processes, creating form agreements, managing legal resources, and providing advice and input on complex business scenarios.
• Drafts, reviews and negotiates contracts to ensure compliance with applicable statutes, case law, governmental regulations and Company policy guidelines.
• Assist with compliance investigations as needed.
• Advise on regulatory frameworks such as EMTALA, HIPAA, Stark Law, the Affordable Care Act (ACA), fraud and abuse, hospital governance and operations, and other federal and state healthcare laws and regulations.
• Lead and manage legal aspects of healthcare operations, including contracts, licensing, reimbursement, and operational policies.
• Draft, review, and negotiate contracts related to healthcare operations, including provider agreements, vendor contracts, and other business arrangements.
• Collaborate with cross-functional teams (e.g., compliance, risk management, finance, operations) to develop and implement strategies that minimize legal risk and support organizational goals.
• Monitor and interpret regulatory changes and trends, ensuring timely implementation of new compliance practices across the organization.
• Provide guidance on risk mitigation strategies in areas such as patient care, billing, reimbursement, and clinical operations.
• Use skill, knowledge and experience to assist Company in amicably resolving disputes with third parties.
• Represent the organization in discussions with government agencies, regulatory bodies, and other stakeholders.
• Stay updated on healthcare industry developments, emerging legal trends, and best practices to provide proactive legal solutions.
Qualifications:
• Juris Doctor (JD) degree from an accredited law school.
• Active bar membership in good standing.
• Minimum of 3+ years of legal experience, with a focus on healthcare law, including significant experience in healthcare operations, compliance, and regulatory matters.
• Deep understanding of federal and state healthcare laws, including HIPAA, Stark Law, the ACA, and other relevant regulations.
• Strong communication, negotiation, and drafting skills with the ability to simplify complex legal concepts for non-legal stakeholders.
• Ability to manage competing priorities and work efficiently in a fast-paced, dynamic environment.
• Exceptional judgment and decision-making skills, with a high level of integrity and professionalism.
• Previous law firm experience required.
• This position does require some travel.
