    POSITION SUMMARY: We have an exciting opportunity to join our team as a Director-Malpractice Claims. In this role, the successful candidate Under the direction of the VP & Senior Associate General Counsel for Malpractice Insurance Administration and Litigation, the primary responsibility of this role is to provide direction and oversight in the daily handling and management of select medical malpractice cases and claims, which are insured under the NYU Langone Hospitals Medical Malpractice Insurance Program. The primary clients are NYU Langone Healths Sr. Vice President/ General Counsel and Sr. Vice President/ CFO. This role will assume all responsibility for the productivity and outcomes generated by the Third Party Administrator team of assigned claims professionals handling individual case loads by proactively coordinating the most reasonable and strategic defenses to optimize claim handling and achieve optimal results. There is a heavy emphasis on the successful management of the claims team with continuous direction setting and management of claims, both in the prelitigation and litigation stages, with a successful yearly case closure target for the team under management.

    JOB RESPONSIBILITIES:

    • Assume primary responsibility for the direct management of the assigned claims handling professionals managing select medical malpractice claims assigned in various counties throughout the state (including NJ and CT) and federal jurisdictions.
    • Will be responsible for the beneficial and successful closure of medical malpractice claims handled by the assigned team.
    • Assist in choice of counsel, as requested.
    • Manage and direct outside counsel, along with resulting litigation costs.
    • Keep VP & Senior Associate General Counsel for Claims Administration for the Malpractice Insurance Program informed of material claims and changes in status of litigation on each individual claim.
    • Initiate early resolution of claims via direct strategic negotiation when appropriate, encouraging mediation and other forms of dispute resolution and judicial intervention, where appropriate.
    • Proactively identify matters to be assigned for the direct handling by Associate General Counsel.
    • Negotiate cases directly with adversaries, as needed.
    • Maintain a direct caseload of up to approximately 25 claims.
    • Stay up-to-date on changes in law and legal climate as relates to malpractice claims.
    • Provide litigation and settlement analysis on all claims and positions on coverage issues.
    • Provide overall day-to-day strategic and proactive planning to Third Party Administrator claims team on the successful management of claims.
    • Provide timely responses to time sensitive projects, as assigned.
    • Attend and travel to all phases of Court conferences and trials for each case, as needed, with timely reporting.
    • Manage and direct, as necessary, defense counsels preparation of key defendants for deposition.
    • Determine, with defense counsel, the most successful settlement/trial strategies.
    • Monitor all phases of trials, reporting to relevant NYULH parties the daily progress with recommendations and modifications of strategies as developments dictate.
    • Participate and present at claims conferences; lead roundtable discussions and committee reviews; present case summaries, as needed.
    • Manage select team to prepare Executive Claims Summary for each case being handled with timely reserve setting recommendations.
    • Keep claims professionals up to date on emerging issues relating to coverage and litigation.
    • Review and manage pleadings, motions, briefs, appellate papers, etc., as needed, to proactively defend and strategically manage litigation.
    • Perform other related duties, as assigned.

    ADDITIONAL POSITION SPECIFIC RESPONSIBILITIES: Under the direction of the VP & Senior Associate General Counsel for Claims Administration, the Director of Claims will be working closely to direct and manage the Third Party Administrator assigned claims handling team managing a select book of malpractice cases insured under the Medical Malpractice Insurance Program. The Director of Claims will also work closely and collaborate with Associate General Counsel handling select malpractice claims, the Insurance Department, and Risk Management. The position will also have the responsibilities listed above.

    MINIMUM QUALIFICATIONS: To qualify you must have a Direct management of a team of claims professionals is required with at least 10 years experience in broad-based medical malpractice claims, which must include experience in insurance law, coverage issues and disputes, and NY litigation. Significant direct negotiation skills and aptitude. Effective oral and written communication skills with the ability to present case reviews and recommendations, work collegially with diverse personnel and under the direction of the VP.
