    1. TASK & DUTIES LIST AND MEASURES OF PERFORMANCE FOR: MUNICIPAL MAGISTRATE

    • PAY STATUS: NON-EXEMPT

    2. REQUIREMENTS:

    Education:

    High school diploma or GED equivalent with specialized course work in general office practices such as typing and accounting. Any equivalent combination of education and experience, with additional experience substituting for the required training on a year for year basis.

    Licensing, Registration or Certification:

    Background check must be satisfactory.

    Pre-employment screenings must be passed.

    Must possess or be able to obtain at time of hire, and maintain a valid driver's license.

    Must be bondable.

    Experience Education and/or experience above or any equivalent combination of education and experience.

    Skills, Knowledge and Abilities:

    Working knowledge of modern office practices and procedures.

    Skill in operating telephone switchboard, fax and copy machines and calculators.

    Ability to perform math computations verbally and in writing.

    Ability to effectively meet and deal with the public.

    Ability to communicate ideas effectively both orally and in writing, with people on all levels and to follow and give verbal and written instructions.

    Ability to establish and maintain effective working relationships with City officials, department heads, associates and the general public.

    Ability to work in stressful situations, with angry or difficult individuals, and respond to all those in contact with in a professional, calm and reasonable

    manner.

    Ability to work under pressure and/or with frequent interruptions.

    Physical: Body Positions: Standing, walking, sitting. Must use hands to finger, handle, feel or operate objects, tools, or controls.

    Must be able to meet any required physical standards.

    Reach with hands and arms. Must be able to occasionally lift and/or move up to 10 pounds.

    Body Senses: Sight, hearing, speech and smell. Must be able to speak and hear. Specific vision abilities include close vision and the ability to adjust focus.

    Mental: Language: Ability to read, speak and write English. Ability to effectively communicate and project positive attitude.

    Must be able to communicate effectively verbally and in writing.

    Supervision Exercised: None

    3. TASKS and DUTIES OF JOB: General Definition: Performs certain clerical and administrative duties involving Municipal court such as setting court dates and receiving bond payments. Works under the general supervision of the Chief Magistrate. While performing the duties of this job, the employee works in a comfortable office environment. Noise level in the work environment is usually moderately quiet.

    1 Maintains the required confidentiality of all work.

    2 Reviews and signs complaints.

    3 Issues warrants that merit probable cause for arrest.

    4 Arraigns defendants.

    5 Per Ordinance 2014-02:

    (a) in the absence of the Municipal Court Judge and the Chief Magistrate, Magistrates and Municipal Court Clerks may act as Municipal Court Judge: Provided, that the Chief Magistrate, Magistrates and Municipal Court Clerks shall comply with the requirements set forth in West Virginia Code 8-10-2(a) and further shall be required to execute the proper oath of office.

    (b) Pursuant to West Virginia Code 8-10-4, authority is hereby vested in the Chief Magistrate and Magistrates to issue warrants for arrest, to administer oaths and to accept and approve sureties and bonds, in the absence of the Municipal Court Judge.

    6 Reads arraignment/rights form to the defendant and obtains defendants signature indicating awareness of the initial court date.

    7 Sets the bond for the charge; collects the bond and submits collected amount to cashier or releases the defendant on his/her own recognizance; processes property bonds and related forms; commits defendants to the regional jail pending appearance before the Municipal Judge.

    8 Signs jail release forms for defendants who are incarcerated in the regional jail.

    9 Any and all other duties assigned by Chief Magistrate.

    4. MEASURES OF PERFORMANCE:
