  • Responsibilities

    We are seeking a knowledgeable and detail oriented Probate Attorney to join our client's legal team. As a Probate Attorney, you will primarily be responsible for guiding clients through the probate process after the death of a loved one. Your role will involve managing estates, advising clients on legal matters related to inheritance, drafting legal documents such as wills and trusts, and representing clients in probate court proceedings.

    Responsibilities:

    Client Consultation and Representation:

    • Meet with clients to discuss estate planning goals, draft wills, trusts, and other estate planning documents.
    • Provide legal advice to clients regarding probate and estate administration.
    • Represent clients in probate proceedings, including contested matters and litigation.

    Estate Administration:

    • Guide and assist executors and administrators through the probate process.
    • Manage the distribution of assets according to the terms of the will or intestacy laws.
    • Prepare and file documents required by probate court.

    Legal Research and Documentation:

    • Conduct legal research on probate laws and regulations.
    • Draft legal documents, including petitions, motions, and pleadings.
    • Review and interpret wills, trusts, deeds, and other estate planning documents.

    Dispute Resolution:

    • Resolve disputes among beneficiaries and other parties involved in probate proceedings.
    • Negotiate settlements and agreements on behalf of clients.
    • Represent clients in mediation, arbitration, or litigation as necessary.

    Compliance and Ethics:

    • Ensure compliance with state and federal laws governing estates and probate.
    • Uphold ethical standards and maintain client confidentiality.

    Qualifications:

    • Licensed to practice law in Texas
    • Proven experience in probate and estate planning law.
    • Strong analytical and problem-solving skills.
    • Excellent communication and interpersonal skills.
    • Attention to detail and ability to manage multiple tasks efficiently.
    • Ability to work independently and as part of a team.
    • Experience with estate and gift tax planning.
    • Prior experience handling complex probate cases or litigation.
